Advice on new boat damage

Hey everyone,
Excited to join the pontoon community leaving my speed boat behind. Unfortunately, things are not working out as planned. Recently, went to a boat show (know probably not the best place to purchase), but was excited the summer season. At any rate, I ended up purchasing just the 20 SV fishing model with mercury 90 on the back. The boats were practically touching which I did not see prior to signing. Days after the boat is still sitting there, I take pictures of all the spots including the pontoons which were touching and finally bug them enough to move it. Drove by and saw them loading it on to the trailer. Of course, I see marks down the rub rails and on the actual pontoons basically at each place it was rubbing. One of them fin on the pontoon was bent (I will upload pictures after posting from phone). Needless to say, I am upset as we have just months to use the boat in the NE. Estimated time on the pontoons 3-4 as long as 7 weeks. Consulted an attorney who basically said they have the right to try to fix it. This place offered to pay payments for the summer and store during the winter. Also open to installing a fish finder. They would pick up the boat and bring it back after everything is fixed. To me seems like I am being forced to continue with a refurbished model or is just placing new pontoons rather benign. I guess I am reaching out looking for any additional advice or thoughts.

Don't want to forget to add this place said Bennington warranty is only good for manufacture defects, and they will deny everything if not kept in the garage. Unfortunately went with a service contract which I believe I can cancel, but currently trying to sort through this as well.
 
When I picked up my 2022 QCW ,port side toon leaked,due to a bad weld . Dealer fixed the leak, toon was replaced during winter storage. If it's not leaking have them fix it in the winter.
 
That is extremely disappointing. Did you ask the dealer just to swap out a new non-damaged boat?
 
Ditto Pbakk’s question. Did you sign off yet on the boat purchase and take the boat, or not…and it’s still up at the dealership?
 
I mentioned swapping the pontoons and rails from a 20 sl and they wanted nothing to do with that. This is the only model close to mine. I could ask about swapping the boats, but then the floor plan goes to the bench in the back and much less room in the boat. Just personal preference I guess, but wouldn’t prefer. Knowing them so far they would likely be resistant given the required changes for the bank ect.
 
we signed all the paper work before they tried to move it. I never did pick the boat up. I went back and got my fish finder before they could start the install.
 
My advice is if it is going to bug you, I would walk. You don’t want it to ruin your experience. Some people have no problem ignoring something like this while others (like me) zero in on it every time I use it. It becomes a bigger issue in my mind. If you can accept it while waiting for the best repair timing, go for it and have a blast!

I am with you 100 percent. Unfortunately so far I think I am legally bound to this boat. I am still searching for a way out, just thought maybe some insight on this forum may balance things out. Just seeing what people think of this situation. My attorney who is a friend of mine feels we do have the obligation to allow repairs in a timely manner, but perhaps the 7 weeks is beyond this mark.
 
Is everything that is damaged able to be fixed? Like those scratches on the side and on the pontoons? Also are they going to address the dark spots on the pontoons? What is that? I would "walk" if you can. But if you are unable to make sure everything is fixed to your satisfaction.......in the off season!
 
None of the damage impacts the safety and usage of the boat. So if you cannot legally walk away from it, it should all be repairable. I would really discuss having it done in the off season (in writing). At least that way you don’t loose time on the boat this summer. OR…use it until they are set for repairs, and then just do a drop off for them to do what they need to do, and pick up after…?

No matter what, sorry you are dealing with all this early on. Such a bummer out of the gate! I hope the boat is otherwise to your liking and you get to enjoy it once everything is properly sorted out.
 
Another option might be to request Vantage Sheild pontoon guards for the sides of the pontoons and to have them upgrade to rubber rub-rails. That way you're better than new and no downtime. Good luck - I bet somebody got in serious trouble for that damage.

Interesting thought. Just looked them up. Yeah I almost think it was the guy loading the trailer. He told the manager people walking on them must have moved them closer which is clearly wrong. They didn’t budge when I was on them.

Thanks for the kind words. I did find a bill of rights for vessels which to my eye looks like they have 30 days to fix it. This does not appear obtainable and may be my way out.
 
Wow, what a bummer. That said, if you can’t walk (and it sounds like you can’t), have the dealer put the repairs in writing and have them completed in the offseason.
